Buy Energy Direct LLC operates as an Energy Service Company (ESCO) regulated by the New York State Public Service Commission. This page explains who we are, how we are regulated, and how to reach us — or the regulator — if you have questions or concerns.

ESCO Identification

Buy Energy Direct LLC is a Licensed Energy Service Company in the State of New York. We supply commercial electricity in Con Edison territory (New York City and Westchester) and commercial natural gas to NYC businesses. We are headquartered in Brooklyn, New York.

Buy Energy Direct is the supplier of your commodity. Buy Energy Direct is not your local distribution utility. The local distribution utility (in our service territory, Con Edison) continues to deliver your energy, read your meter, issue your bill, and respond to outages and emergencies. The supplier-utility distinction is required by the New York Public Service Commission and is reflected on every customer’s bill.

Regulatory Framework

Buy Energy Direct’s marketing, enrollment, contracts, and customer service practices are governed by:

  • The New York State Public Service Commission’s Uniform Business Practices for Energy Service Companies (16 NYCRR Part 10), as effective April 2026.
  • The New York General Business Law, including GBL §349 (deceptive acts) and GBL §349-d (energy services).
  • The federal Telephone Consumer Protection Act (TCPA, 47 USC §227).
  • Tariffs and operating procedures of the Local Distribution Companies (Con Edison) and the New York Independent System Operator (NYISO).

ESCO Consumer Bill of Rights

The New York Public Service Commission publishes an ESCO Consumer Bill of Rights describing customer rights and protections in dealings with energy suppliers. The current version is available at: https://dps.ny.gov/esco-consumer-bill-rights.

Pricing & Contract Disclosure

Buy Energy Direct does not post retail commodity rates on its public website. Specific rates are quoted at the time of contracting based on the prospective customer’s usage profile, term length, and prevailing market conditions, and are reflected on the executed Customer Disclosure Statement and Sales Agreement provided to every customer at enrollment.

Savings are not guaranteed. Energy markets fluctuate; supply rates contracted with Buy Energy Direct may be higher or lower than the local utility’s default supply rate at any given time, depending on plan structure, term, and market conditions.

The complete terms and conditions applicable to Buy Energy Direct customers are published on our Terms & Conditions page, including the Customer Disclosure Statement template (Section 1) summarizing the key commercial terms of every Sales Agreement: price, price structure (Fixed/Variable/Index), Initial Term length, rescission, Early Termination Fee, late fee, returned-payment fee, renewal provisions, conditions for any guaranteed savings (none), and compensation paid to Energy Brokers or Consultants.

Compensation Disclosure

Buy Energy Direct may compensate Energy Brokers, Consultants, or sales agents who refer or enroll commercial customers. Such compensation may take the form of a one-time fee, a commission paid over the term of the Agreement, or a per-unit adder reflected in the rate the customer pays. The specific form, amount, and method of compensation paid in connection with each customer’s Agreement, if any, are disclosed on the executed Customer Disclosure Statement provided to that customer at enrollment.

Note: Under the Uniform Business Practices, the DPS generally does not adjudicate non-residential commercial billing disputes; however, you may still file a complaint with the DPS, and the DPS retains regulatory authority over Buy Energy Direct’s marketing, enrollment, and contract practices.

Emergency Contact

Buy Energy Direct does not respond to outages or emergencies. The local distribution utility delivers energy and is responsible for service emergencies. For a gas leak, electrical outage, or any service emergency, contact Con Edison immediately at 1-800-75-CONED (1-800-752-6633). If a gas leak is suspected, leave the area first and call from a safe location.
