This Privacy Policy describes how Buy Energy Direct LLC (“Buy Energy Direct,” “we,” “us,” or “our”) collects, uses, and shares information in connection with our public website at buyenergydirect.org and our commercial energy supply business in New York. We provide commercial electricity and natural gas supply to non-residential customers; we do not market to or contract with residential consumers.
1. What we collect
Information you provide
- Quote and contact submissions: company name, contact name, role, email address, phone number, service type interest, Con Edison account number (if provided), approximate usage, and any free-text message you choose to send.
- Enrollment and account information: if you become a customer, additional information needed to establish service — including authorized signatories, billing address, service address, tax exemption status (if any), and authorization for us to obtain account history from your local distribution utility.
- Customer service correspondence: records of communications with our customer service team, including phone-call notes, emails, and supporting documents you send us.
Information we receive from third parties
- From your local distribution utility (Con Edison): consumption history, billing determinants, account number, credit information, tax status, and information needed to provision and bill service. We obtain this information under the authorization granted in your Sales Agreement.
- From credit reporting agencies: commercial credit information used to assess eligibility for service.
- From energy brokers, consultants, or referral partners: information they collect from you in the course of recommending or arranging your account with us.
Information collected automatically
- Site usage: IP address, browser type and version, device type, referring URL, pages visited, time of visit, and similar technical information collected by standard web logs.
- Cookies and similar technologies: we may use cookies for site functionality (for example, to remember form values within a session) and for limited analytics. You can disable cookies in your browser; doing so may affect site functionality.
2. How we use information
We use the information we collect to:
- Respond to quote inquiries and prepare proposals sized to your usage profile.
- Establish, administer, bill, and service your account if you become a customer.
- Coordinate enrollment, switching, and termination with the local distribution utility.
- Communicate with you about your account, your contract, your invoices, your renewal, and any service-related matters.
- Comply with regulatory obligations under the New York Public Service Commission Uniform Business Practices, the New York General Business Law, applicable tax laws, and other applicable rules.
- Maintain records of marketing, enrollment, and contracting activity for the periods required by law (including UBP §5.B.5.e and related record-retention requirements).
- Detect, investigate, and prevent fraud, abuse, or violations of our Terms.
- Improve the operation and security of our website and internal systems.
We do not use the information you provide on our website for marketing communications by phone or text message unless you have separately and affirmatively opted in to such communications. Marketing consent is not a condition of service.
3. How we share information
We share information only as needed to operate our business and meet our regulatory obligations. Specifically:
- With your local distribution utility (Con Edison): to enroll, maintain, bill, and remove your account, and to coordinate switching and emergencies.
- With the New York Independent System Operator (NYISO) and other electric/gas market operators: to the extent required to schedule, balance, and settle commodity supply.
- With energy brokers, consultants, or referral partners: who participated in arranging your account, limited to the information necessary for them to perform that role.
- With service providers: such as billing processors, payment processors, hosting and email providers, customer-relationship-management software, and professional advisors (legal, accounting, audit), under contractual obligations to safeguard the information.
- With regulators, courts, or law enforcement: when required by subpoena, court order, regulatory request (including the New York Department of Public Service), or other applicable legal process; or to defend our legal interests.
- In connection with a corporate transaction: such as a merger, acquisition, financing, or sale of assets, subject to the receiving party’s commitment to handle the information consistent with this Policy.
We do not sell information about you. We do not share your information for unrelated third-party marketing purposes.
4. How long we keep information
We retain information for as long as needed to provide our services, manage our customer relationships, comply with our legal and regulatory obligations, and resolve disputes. Sales-agreement records, click-acceptance logs, and related enrollment evidence are retained for at least the period required by the New York Uniform Business Practices (UBP §5.B.5.e) and related rules. Tax and accounting records are retained for the periods required by applicable tax law. Other records are retained for the period reasonably required for the purpose for which they were collected.
5. Data security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect the information we hold. No method of transmission over the internet or method of electronic storage is fully secure, and we cannot guarantee the absolute security of information transmitted to us.

- Marketing opt-out: you may opt out of marketing communications at any time by contacting us using the information below. Opting out of marketing does not stop service-related communications about your account.
- Access and correction: you may contact us to request access to or correction of information we hold about your business account, subject to applicable law and our recordkeeping obligations.
- Cookies: you may disable cookies or similar technologies through your browser settings; site functionality may be affected.
7. Children
Our website and services are directed to commercial businesses and the people who manage them. We do not knowingly collect personal information from children under 16.
